WORKING ABROAD - MISCONCEPTIONS

17/02/2021

Recently, the managing partner of LSP, Master of Law of Washington University in St. Louis and Tecnlógico de Monterrey - Berzhanov Tabyldy gave an interview to the BAIGE NEWS portal. About the current problem of fraud in the field of employment abroad. For more detailed information about the educational center that offered" help " to Kazakhstanis in finding a job abroad, please follow the link below.

We will only voice our opinion of our lawyer about the misconceptions that most often appear in our compatriots.

First, the official employment of Kazakhstanis abroad is carried out according to the rules of the European Union.

Secondly, the procedure for registering an employee can take a long time - up to one year. (Do not believe people who say that they will get you a job in conditional Poland in less than a month)

Third: a citizen of Kazakhstan does not receive a residence permit, but a blue card - it gives the right to work in the EU countries and move freely there. And, of course, the person must get a work visa.

Fourth: the EU countries mainly require qualified personnel with at least a higher education. By the way, the most popular professions can be seen on the EU website. Accordingly, the salary of a foreign SPECIALIST should be one and a half times higher than the minimum wage in Europe (roughly speaking, in 2020 it was about 4,500 euros per month).

Fifth: only after working with a blue card for one and a half to two years in Europe, a person has the right to apply for permanent residence. If he worked, regularly paid taxes, the migration department can issue a card at his permanent place of residence. This is an option for a foreigner to apply for permanent residence. The only exception can be an investor visa, the presence of which already gives the right to obtain permanent residence. The amount of investment in this case must be at least 500 thousand euros.

A direct quote from an LSP lawyer on this topic: "A blue card is issued for a period of at least one year. To get it, you need an employment contract from the employer. The embassy conducts interviews, accepts documents, gives a notification with which the person goes to the local migration department and receives a blue card. But this is not a residence permit. In addition, to get a blue card, you need to prove your high qualifications at the embassy. The presence of higher university education is mandatory - bachelor, master, etc. Each European country puts a priority list of professions on the EU website. And they have enough cleaners and sorters of their own»
