The Legal Services Provider company invites you to get acquainted with the updates in a very important order of the Ministry of Internal Affairs, the basics of which were developed on February 8, 2014. But, due to technological progress, the situation in the country's foreign policy and quarantine restrictions, this order is subject to updates and changes.

To begin with, let's figure out who a "migrant worker"is. This definition is not suitable for a person working in a large company. Migrant worker-performs certain work for a private individual. A common example: a nanny, a handyman, a builder, etc. The

main changes were related to the digitalization of the document flow for the best control and convenience of the migrants themselves. Below we will give a brief overview of the changes, but after that, be sure to read the original order that we will attach.

The current updates of the order are dated January 15, 2021:

- For the public service individual immigrant labor (further - uslugopoluchatel) delivers in person at non-profit joint stock company "State Corporation "Government for citizens" (hereinafter - the State Corporation), or through the web portal of "the electronic government" (further - the portal) package of documents in accordance with the list provided by the Standard of the state service in accordance with these Rules.

Employee of the State Corporation prepares an electronic application in the Integrated information system "service Centers" (hereinafter - PSC IIS), with the electronic copies of documents and send to the Information system "Immigration police" (IP MP) for appropriate action.

- The service provider on the day of receipt of documents from the State Corporation through the IP MP checks for compliance with the requirements of the Law of the Republic of Kazakhstan "On Migration of the Population", including:

1) compares the content of the application with the data of the identity document and the information obtained from the IP IP and from other sources;

2) checks the citizenship of the foreigner with the list of countries with which the Republic of Kazakhstan has concluded agreements on visa-free entry and stay, providing for the possibility of staying in the Republic of Kazakhstan without a visa for a period of at least three months;

3) verifies that the amount of the advance payment for individual income tax paid corresponds to the period of validity of the permit for a labor immigrant specified in the application;

4) checks the databases of the internal affairs bodies and the Committee on Legal Statistics and Special Records under the Prosecutor General's Office of the Republic of Kazakhstan for criminal records and search, the results of the check are attached to the materials;

5) attach the documents specified in the State Service Standard to the accumulative materials that are produced for a labor immigrant.

If the service recipient provides false information, the service provider, on the day of receipt, within 30 minutes, sends a decision to refuse to provide the state service in the form through the IP MP to the IC PSC.

- Positive result of consideration of the application - in the form of a permit (extension) for the employment of foreigners from individuals received by the IC PSC through the IP MP in electronic format, containing a unique " QR " code, printed out by an employee of the State Corporation in two copies and issued to the service recipient, the second copy is attached to the materials.

When applying through the portal, after successful verification of the application received by the IP MP in automatic mode, the extended permission form becomes available for download in the personal account of the service recipient on the portal.
